When New York doctors fail to diagnose their patients’ conditions and their patients suffer harm from these conditions, the doctors may be held financially responsible through the civil court system. In a recent out-of-state medical malpractice case, a man claimed that a hospital was negligent in not properly diagnosing his leg pain. The alleged failure to diagnose condition reportedly caused him to suffer harm.
According to the suit, the man went to the hospital for treatment since he was experiencing pain in his lower left leg. He asserted that physicians conducted a physical exam and also ordered testing. However, the doctors allegedly did not recognize that he had rhabdomyolysis and compartment syndrome.
The man also claimed that the hospital treated him only with pain medication, and this masked his problems. He alleged that when he went to a different hospital the following day, he received a proper diagnosis and had to undergo several surgeries along with a long hospital stay. However, a couple of doctors from the first hospital denied that the plaintiff was injured as much as he has claimed to have been injured. The defendants have also asserted that the man’s injuries are really the result of others’ conduct.
In his medical malpractice lawsuit, the man is pursuing damages totaling more than $50,000. If a patient’s condition is not correctly assessed by a health care professional in New York, he or she retains the right to seek compensatory damages, and perhaps even punitive damages, in cases involving egregious fault. Any monetary damages that are achieved through a medical malpractice suit may help to cover medical costs and other expenses resulting from the malpractice incident.
