When a person is suffering from an illness in New York, he or she typically trusts a physician to correctly diagnose him or her and then treat the condition. Proper diagnosis, however, does not always happen. The surviving family members of one man who passed away from cancer have filed a lawsuit against one doctor, claiming that the doctor engaged in medical malpractice by not diagnosing the man correctly, which resulted in his death.
According to the man’s family, the man went to the hospital with complaints of weakness in the left arm, vomiting, nausea and fainting. A cardiologist ordered for his left arm to be scanned, and a radiologist noticed that a lymph node was inflamed, which might have been an indicator of cancer. The family said that the cardiologist, however, failed to read the whole report and approved it without following the recommendation of the radiologist to test the man for cancer.
According to the complaint, the man later went back to the hospital with heaviness in his chest. He was diagnosed as having carcinoma and numerous tumors, and these tumors had already metastasized, reaching the liver and adrenal gland. The man eventually died from cancer of the lung.
As part of the medical malpractice suit, the family is seeking unspecified damages for medical expenses, as well as pain and suffering. If doctors in New York fail to exercise a reasonable degree of care when it comes to diagnosing or treating their patients and the patients die, it is within the family members’ right to file lawsuits for compensatory damages. A case that is fought victoriously may lead to damages that can help to cover financial expenses linked to the incident.
