The Broome Bands Together Summer Concert Series offers free, family-friendly concerts from 6:00 p.m. – 8:00 p.m. on Tuesday nights (weather permitting) starting June 6th to August 15th at Otsiningo Park in Binghamton, NY.

Congratulations to Mark Gorgos, partner at Coughlin & Gerhart, LLP, who was recognized for his 6 years of distinguished service on the New York State Third Department Attorney Grievance Committee (“AGC”), at a ceremony last Friday in Albany. In addition to his Committee membership, Mark served as Chair of the 21 member Committee in 2022. Members of the AGC are appointed by the Justices of the Supreme Court of New York State, Appellate Division 3rd Department, which covers an area from Corning to Albany to Plattsburgh. The Committee meets monthly to review complaints filed against attorneys for alleged violations of ethical rules. Members of the Committee are highly regarded for their professional integrity and knowledge of the rules and laws that govern attorney conduct in New York.

Coughlin & Gerhart, LLP has announced that the Firm’s Partners have elected Rachel A. Abbott as the Firm’s new Managing Partner.

Coughlin & Gerhart is a 55-attorney general practice law firm that is based in Binghamton and has offices in Bainbridge, Cortland, Ithaca, Owego, Hancock, Walton, New York and Montrose, Pennsylvania.

Ms. Abbott, who has been with the Firm since 2005, succeeds Mark S. Gorgos as Managing Partner. Ms. Abbott’s term will begin January 1, 2023. Mr. Gorgos has led Coughlin & Gerhart since 2005.

As Managing Partner, Ms. Abbott will oversee general firm management and be responsible for guiding the firm’s vision, strategy, growth, innovation, and culture.

“I am honored to assume the role of Managing Partner for C&G and I feel fortunate that Mark has steered this Firm in such a strong position during the past 17 years,” Ms. Abbott said. “Our Firm has only had two prior Managing Partners. I look forward to leading a client-centric and community focused team to deliver the highest level of legal services to our clients.”

Mr. Gorgos, who had advised his Partners months ago that he would not be seeking another three year term as Managing Partner, will remain active in the firm. He’ll continue his busy practice in the areas of business & banking, education law, and complex financial transactions.

“While I have enjoyed my years as Managing Partner, at some point you have to transition to new leadership. Rachel and I have been working on this process for a year and a half. Coughlin & Gerhart, LLP is pleased to announce that attorneys Nicholas Cortese and Keegan Coughlin became Partners in the firm, effective January 1, 2023.

Mr. Cortese began his legal career as an Appellate Court Attorney for the New York State Supreme Court, Appellate Division, Third Department. From there, he was appointed as Senior Law Clerk to Third Department Justice Robert S. Rose. After his clerkships, Mr. Cortese entered private practice with a law firm in Syracuse, New York, before returning home to Binghamton in 2017 to join Coughlin & Gerhart.

Mr. Cortese primarily practices in the Firm’s Public Law group. His diverse practice includes the representation of municipalities, school districts, fire districts and emergency services providers on a wide range of legal issues. He also focuses on appellate, special proceedings and real property tax litigation, as well as administrative hearings and investigations.

Mr. Coughlin grew up in Johnson City, NY and joined Coughlin & Gerhart, LLP as an associate in 2016. His practice is concentrated in the areas of estate planning, trust & estate administration, and municipal & public law.

Mr. Coughlin is a member of the New York State Bar Association, as well as the Broome County Bar Association. He began his legal career as a law clerk with the Binghamton City Court while attending law school. He later served as a student judicial law clerk to the Honorable Thomas J. McAvoy, Senior U.S. District Judge in the U.S. District Court for the Northern District of New York.

Begeal. “There are a lot of important responsibilities associated with being an elected member of the firm’s Executive Committee and I’m humbled that my fellow partners trust me with this duty,” says Luce.

Ms. Luce joined Coughlin & Gerhart in 2007 and is a partner with the firm. Her practice is concentrated in the areas of Estate Planning & Wills, Probate and Trust & Estate Administration, Real Estate Law, Elder Law & Guardianships, and Litigated Estate Matters.

Cheryl, whose primary area of practice is Public Law, has been with Coughlin & Gerhart since 2007. She’s been a member of the Broome County Bar Association since 1999 and was a Director from 2007-2010. Sindy Garey, from the Broome County Bar Association says “Cheryl has spent countless hours volunteering for various aspects of the BCBA for many years. In fact, from the day she first became a member and continuing through today – she has ceaselessly worked to provide service and benefits to the members of the BCBA. On May 13, 2021 the Greater Binghamton Chamber of Commerce held their 57th Annual Dinner and Meeting where they announced the 2021 award recipients. The Chamber named Coughlin & Gerhart attorney Mark S. Gorgos as the 2021 Civic Leader of the Year. The Chamber details that “The Civic Leader of the Year shows evidence of having had a long-term beneficial impact on the community. They demonstrate civic engagement by using a combination of knowledge, skills, values and motivation to make a difference in our communities.”

Mark was nominated for the award by Michael Grasso, the Executive Director of the ‎Roberson Museum and Science Center, along with other supporting nominations.

As the nominations and the Chamber conveyed, Mark has been practicing law in our community since 1980. As the Managing Partner of the firm, Mark’s responsibilities involve overseeing and coordinating the firm’s donations, sponsorships, and public service events in the community. In 2019, Coughlin & Gerhart received the NYS Bar Association President’s Pro Bono Award in the mid-size firm category. Arlene Sanders, Director of Pro Bono Programs for the Legal Aid Society of Mid-New York, said “Under Mark’s leadership, Coughlin & Gerhart makes pro bono service a strong priority within the firm.” Mark and Coughlin & Gerhart have been supporters of Legal Aid’s annual fundraiser, the Race for Justice 5K Run/Walk, which has raised over $50,000 to benefit its programs.

The nominations also detailed that a large part of Mark’s time is dedicated to the community. For example, Mark currently volunteers as the Board President for the Roberson Museum and Science Center, a position he has held since 2017. When unusual issues arise, Mark has been there to assist, such as in 2019 when, over a Holiday weekend, a pipe burst! Mark was there to lend a hand with clean up and restoration. Mark’s impact and influence spread throughout the community in various positive ways, with the examples Mark sets for Board service being passed on by other Roberson Board trustees as they move on to serve other organizations.

Outside of the office, for more than thirty years, Mark has been a fixture in the area’s local youth sports leagues. He has coached soccer, baseball, softball, and basketball. He was even recognized for his accomplishments in youth soccer by being one of four finalists for the National Youth Soccer Coach of the Year.

Elizabeth Woidt, Director of Parks, and Recreation and Youth Services for Broome County pointed to the “Broome Bands Together,” free summer concert series presented by Coughlin & Gerhart which takes place at Otsiningo Park. Since 2013, the series have provided a safe, free, and family-friendly event for residents and visitors. She noted that “Mark is an outstanding ambassador for Coughlin & Gerhart as well as Broome County Parks. He has a burning desire to promote the quality of life in Broome County.”

In addition, he has been a member of the Community Foundation for South Central New York Board of Directors since 2016. Mark serves as chair of their Planning Committee and is a member of the Personnel Committee. Executive Director Diane Brown jokes that being a member of their Board is a “lifetime commitment.” She says Mark is exactly the person she looks to for leadership… “he is knowledgeable, thoughtful and unflappable.”

The firm extends a big “Congratulations!” to Mark Gorgos, and a “Thank You” to the Greater Binghamton Chamber of Commerce, and all those individuals listed above who nominated Mark for this award in recognition for his years of service to our communities.

Legal Update: New York State Legalizes Adult-Use Cannabis

On March 28, 2021, New York State Governor Andrew Cuomo announced that he had reached a tentative agreement for comprehensive legislation that would, among other things, legalize the recreational use of cannabis products for adults. Three days later, he signed the legislation into law. Congratulations to Tom Bouman, whose third novel, The Bramble and the Rose, was named to the WALL STREET JOURNAL’s list of THE BEST BOOKS OF 2020! This is quite the accomplishment and Coughlin & Gerhart, LLP is honored to count Tom as one of our litigation and trust and estates attorneys.

This third installment of his mystery series follows Officer Henry Farrell on another investigation in Wild Thyme, Pennsylvania, a fictional town just south of the Binghamton area. At first it looked like a bear attack–an open-and-shut case. Then Henry discovers that the victim was an out-of-town investigator, and the evidence points in troubling new directions. As the story unfolds, Farrell’s past collides with his present as an ex-flame reappears, and his own nephew disappears into the hills.

“We are honored and excited to have former New York Supreme Court Justice Ferris D. Lebous become part of the Coughlin & Gerhart team. He will add tremendous experience and expertise as part of our firm’s Litigation Practice Group,” said Managing Partner, Mark Gorgos.

Lebous was born in Binghamton, NY and served as an Assistant District Attorney and Senior Assistant District Attorney for Broome County between 1980 and 1982. He then entered private practice and was a member of the Binghamton firm of Pearis, Ressiguie, Kline, Barber & Lebous until his appointment to the Court of Claims by Gov. George E. Pataki on May 7, 1998.

He is a member of the New York State Bar Association and a member and past president of the Broome County Bar Association. He was elected to the Supreme Court in 2006.

“After leaving the bench at the end of 2019, I was happily retired after my 21 years of service as a trial judge. Update on C&G’s COVID-19 Response (As of June 1, 2020)

As of June 1, Coughlin & Gerhart office locations have re-opened to the public to the extent necessary for legal matters. For everyone’s safety, C&G has implemented the following prevention measures for our employees and guests:

  • Everyone to wear face coverings/masks at all times.
  • Maintain social distancing separation of 6 feet.
  • Attest to your current condition and well-being upon arrival.

Debra Oakes, a Legal Secretary with Coughlin & Gerhart, LLP, was recently awarded the 2019 Pennsylvania Bar Association’s (“PBA”) Pro Bono Partner Award. Frank O’Connor, the PBA Past President & Susquehanna County Wills for Heroes (“WFH”) Coordinator, presented Debra with the award at a recent Wills for Heroes event held in Montrose, Pennsylvania.

Debra was honored with the award for being “a driving force for the Susquehanna County Wills for Heroes Program.” This event provided free estate planning services to approximately thirty veterans and first responders. Debra devoted many of her nights and weekends to help plan and volunteer at the event. Debra worked closely with the current PBA WFH Coordinator, Gabriele Miller-Wagner, over the last several years to schedule and organize each event from start to finish.

Coughlin & Gerhart was recently honored with the CORPORATE CITIZEN OF THE YEAR AWARD by the Broome County Chamber of Commerce at the annual Community Thanksgiving Luncheon on November 17. The award is “awarded to a company that has made not only a financial commitment to the Greater Binghamton area, but a commitment to providing leadership and hands-on employee participation.”

Managing Partner Mark Gorgos credited Coughlin & Gerhart‘s staff, associates and partners for pointing out what’s needed and facilitating volunteerism.

“Really, community service is not just the right thing to do,” he said. “It’s really the fabric of our law firm and I’m really proud of my partners for sharing those visions and initiative with us.”

We at C&G thank the Chamber for this award, and thank all of our employees and other individuals and businesses in the community whose efforts and contributions enable us at C&G to give back to the community.

In presenting the award, the Chamber discussed some of C&G’s charitable fundraising and efforts through the year and stated:

“The attorneys and staff at Coughlin & Gerhart have a strong belief that their community efforts and contributions made to those in need enhance the quality of life for everyone. This attitude definitely comes from the strong examples set by the leadership of the firm. This past July marked the 15th annual “Golf for Scholars” tournament that the firm organized and runs. To date, over $180,000 has been raised to benefit local school districts’ scholarship programs. For the second year, Coughlin & Gerhart was the lead sponsor of the Race for Justice 5K to benefit the Legal Aid Society. The firm also paid the registration fee for any employee and their family member(s) who wanted to walk or run the race.

Coughlin & Gerhart contributes to a host of other organizations. They are a major contributor to the United Way, with a different Staff person running the campaign each year. This year, a basket raffle competition between practice groups will be held to help raise money for the campaign. Coughlin & Gerhart is a Lead Sponsor for the Annual Sertoma Club Antique Show; and a consistent sponsor of the Helping Celebrate Abilities (HCA) Tasteful Day fundraiser.

The Firm holds ‘Jeans Day’ every Friday; donations are collected from partners, associates and staff for the ‘privilege’ of wearing jeans to work. All donations are then given to a local charity, suggested by the employees.

They actively support many of the area’s charity golf and basketball tournaments. They also sponsor ACHIEVE’S ‘Growing Spaces, Improving Lives’ building rehabilitation project. Not only are monetary donations made to local organizations, but attorneys and staff are encouraged to give of their time and talents to these organizations. Over 60 attendees from local businesses were advised of important changes being implemented by the NLRB. The co-chairs of the firm’s Labor and Employment Law Group, Joseph J. Steflik, Jr. and Paul J. NYS Court of Appeals Issues Favorable Decision for Coughlin & Gerhart Clients on Critical Oil & Gas Lease Interpretations

The New York State Court of Appeals issued a landmark decision in a Force Majeure case being handled by the attorneys at Coughlin & Gerhart, LLP, finding that the Force Majeure clause did not extend the leases and that the leases expired by their terms. The case came before the New York State Court of Appeals when the United States Court of Appeals for the Second Circuit certified two questions. This important decision remains very meaningful to landowners for future gas development.

In this lawsuit, Coughlin & Gerhart, LLP represented landowners against three energy companies on the issue of whether the term of expired oil & gas leases can be extended by Force Majeure due to the moratorium on high-volume hydrofracking in New York. The New York State Court of Appeals held that the Force Majeure clause did not modify the habendum clause (term clause) and, therefore, the leases terminated at the conclusion of their primary term. This is a significant victory for landowners and their property rights. The Plaintiffs in this case will now have the opportunity to renegotiate their oil and gas leases when gas development begins in New York and are no longer burdened by the very poor terms of the previous leases. Additionally, landowners who were not a part of this case will benefit from this precedent-setting decision which highlights the importance of having a skilled and experienced oil and gas attorney review an oil and gas lease before signing.

Second Circuit Issues Recent Decision on Force Majeure Asserted by Energy Companies in Oil & Gas Leases

The United States Court of Appeals for the Second Circuit has certified two questions for the New York State Court of Appeals in a Force Majeure case being handled by the attorneys at Coughlin & Gerhart, LLP, finding that the case raises significant and novel questions of New York oil & gas law.

In this lawsuit, the lawyers of Coughlin & Gerhart represent landowners against three energy companies on the issue of whether the term of expired oil & gas leases can be extended by Force Majeure due to the moratorium on high-volume hydrofracking in New York. The trial court, the U.S. District Court for the Northern District of New York, had previously ruled in favor of our landowner clients
, concluding that the leases cannot be extended; the energy companies appealed. This Second Circuit decision was rendered in connection with that appeal. Coughlin & Gerhart and its landowner clients are now waiting for the NYS Court of Appeals to determine whether they will accept the offer to decide the certified questions.
