Man files medical malpractice suit after allergic reaction

A man in another state recently claimed that a radiologist caused him to suffer a life-changing allergic reaction. He is thus seeking monetary compensation for the injuries he suffered as a result of the alleged medical malpractice accident. Likewise, patients in New York who suffer harm at the hands of doctors have the right to seek damages through the civil court system.

In the recent out-of-state case, the 45-year-old man reported that he went to the hospital for magnetic resonance imaging. However, he reportedly ended up suffering a reaction to a chemical element known as gadolinium. This allegedly caused the man’s heart to quit working, which led to brain damage.

The man thus decided to file a malpractice suit against both the radiologist and the hospital. He claimed that both of these parties failed to follow procedures and policies that might have prevented his injuries. According to the man, the hospital in particular should have had a drug box or alarm in the magnetic resonance imaging room, as this would have sped up his transfer to the emergency department for treatment.

Doctors in New York and elsewhere are expected to exercise a reasonable degree of care when evaluating, diagnosing and treating patients. Unfortunately, this does not always happen, which is grounds for filing a medical malpractice suit against the negligent practitioners. An understanding of the facts that have to be proved will likely be critical for succeeding in this type of civil court case. A claim that is fought successfully might lead to monetary damages to cover ongoing medical costs and other losses tied to the documented medical malpractice incident.
