Single vehicle car accidents typically leave unanswered questions

Two men lost their lives in an upstate New York single-vehicle crash that occurred shortly after midnight on a recent Thursday. Accident reconstruction teams are typically called upon to find answers to the many questions authorities have after car accidents that involved only one vehicle. The process is even more challenging when there are no survivors to answer questions about the crash.

Although the investigation is ongoing, a preliminary accident report indicates that a car with two occupants was southbound on Route 481 when the driver lost control of the vehicle and crossed over into the northbound lanes. The car came to a halt on the east side of Route 481 north after rolling several times. During the rollovers, both the occupants were ejected.

Reportedly, a 28-year-old man died at the crash scene, and a 24-year-old man was rushed to a hospital in a critical condition. However, he succumbed to his injuries later. The sheriff’s office reported that the man who died in the hospital was the driver, but until the investigation is complete, this will remain an open question.

Whenever drivers cause car accidents that lead to the deaths of their passengers, the surviving family members of the deceased passengers might have grounds to file wrongful death claims against the drivers. However, when pursuing damage recovery, they will have to prove that the driver was negligent in a manner that caused or materially contributed to the crash. In a case like this one, in which the driver does not survive, the civil lawsuit could be filed against his or her estate. This is a complicated legal process that might be simplified with the support and guidance of an experienced New York wrongful death attorney.
