Fertility clinic faces medical malpractice claim

A New York couple struggled for years to become pregnant. After seeing an online advertisement for a fertility clinic in another state, they invested $100,000 in its services. Doctors were to use the embryos of the couple for the treatment. However, the clinic is now facing a medical malpractice lawsuit that was filed by the couple who claims that the wife gave birth to twins that are of a different race.

According to the plaintiffs, they became suspicious after receiving the results of a sonogram within the first few months after becoming pregnant. The couple asserts that the doctors told them that only female embryos were used, but the sonogram showed that the twins she was carrying were both boys. When they queried the doctors about this, they were allegedly told that it was an inaccurate sonogram.

Court documents indicate that, after giving birth at the end of March, the couple’s concerns became a reality. The parents, who are of Asian descent, now had twin boys of another race. This was when they realized that, instead of using only their genetic material, the fertility clinic doctors used the embryos of other individuals in their fertility treatment. The lawsuit accuses the doctors, the clinic and affiliated companies of medical malpractice. They allege the infliction of emotional distress was intentional.
