Doctors and other healthcare providers in New York have a responsibility to provide care of an acceptable standard. Unfortunately, not all medical care providers follow these rules, often leading to medical malpractice lawsuits filed by victims of negligent medical care. Medical providers may be held liable for harm to a patient caused by a doctor’s failure to comply with the required standard of care.
A family in another state recently filed a lawsuit against several medical professionals who were involved in the medical care of their mother. The plaintiffs allege the doctors had duties to use their skills and knowledge to provide prudent medical care. Court documents show that the plaintiffs claim the defendants frequently prescribed excessive quantities and high doses of opioid medications, including oxycodone, rather than considering available alternative treatments.
Court documents indicate that their mother died at her home while she was under the care of the defendants. They claim an oxycodone overdose caused her death that she was prescribed to use for pain. The plaintiffs seek a monetary judgment to cover legal costs and any financial relief the court will award.
Victims of medical errors or negligence in New York — or the surviving family members of those who died as the result of substandard medical care — may have grounds to pursue financial relief. However, establishing negligence on the part of a medical professional may be challenging. This might be a task for which an experienced medical malpractice attorney will be best equipped. A lawyer can provide the necessary support and guidance throughout the ensuing legal proceedings.
