Car accidents involving drunk drivers can lead to civil lawsuits

People who choose to get into the car of a driver who is impaired put their own lives on the line. Car accidents caused by drunk drivers often leave passengers critically injured or worse. A New York crash recently caused severe head injuries to a 25-year-old woman who was a passenger in the car of an alleged impaired driver.

Nassau County police reported that a 27-year-old man crashed into a parked car shortly before 4:30 a.m. on a recent Saturday morning. The driver suffered lacerations on his face, and his passenger was rushed to a hospital from where her condition was reported to be critical. The driver was charged with vehicular assault, reckless endangerment and second-degree assault.

Police say a second driver of another car was also arrested for drunk driving. This 30-year-old man apparently knew the alleged drunk driver and stopped to help him. Police determined that this driver has a record of DWI, and he will also face charges of marijuana and cocaine possession.

Victims of car accidents that were caused by the recklessness of others can pursue financial relief — even if they were passengers of those drivers. They can file personal injury lawsuits in a New York civil court, and they will have to prove that their injuries were caused by the negligence of another party. They may need the help of an experienced personal injury attorney to establish negligence before the court will adjudicate their documented claims. Financial losses like medical expenses and lost income can be claimed, along with emotional damages such as pain and suffering.
