Medical malpractice suit filed following knee surgery

A doctor’s failure to diagnose a patient’s medical condition in New York may unfortunately lead to serious harm to the patient, if not death. One man in another state recently filed a medical malpractice suit against a physician and hospital after they allegedly failed to diagnose an infection. The infection reportedly occurred after the man had knee surgery.

According to the man’s complaint, he experienced pain between October of 2014 and December of 2015 because of a bacterial infection in his knee following surgery. He claimed that the doctor and medical center were responsible for this infection because they did not correctly evaluate his condition. They also are blamed for not providing the man with the necessary post-surgery care.

The plaintiff asserted that his right-knee prosthesis ended up having to be replaced because of his knee infection. As part of his lawsuit, the man is requesting a jury trial. He is also seeking compensatory damages as well as double damages, punitive damages and all medical costs and legal fees.

When a medical malpractice incident leads to serious injuries to a patient in New York, the patient has the right to file a suit against the allegedly at-fault doctor and/or medical center, seeking damages. Punitive damages in particular can be awarded in cases of egregious fault. A financial award in a successfully litigated case cannot undo the events leading to an injury caused by medical malpractice, but it may help the patient to cover his or her related medical costs as well as help to address emotional distress caused by the incident.
