In one out-of-state case, a man recently underwent ankle surgery and claimed that it was botched. Thus, he has filed a medical malpractice lawsuit against the hospital and doctor responsible for the surgery.
According to the man’s lawsuit, both the doctor and the hospital were negligent in his surgery. The man alleged that both parties did not provide appropriate medical care. Specifically, they are blamed for not performing the proper ankle surgery.
The plaintiff claimed that his right ankle was permanently damaged following the surgery. He claimed that he later learned he needed to undergo fusion ankle surgery. As part of his lawsuit, he is seeking a judgment of over $50,000 against each of the defendants.
If doctors and medical facilities in New York are careless in their treatment of patients and their patients suffer injuries as a result, the harmed patients have the right to take legal action. They may pursue compensatory damages in medical malpractice lawsuits, with punitive damages also having the potential to be awarded in cases of egregious fault. Financial restitution from a successfully litigated case may help to cover health care costs and other expenses tied to documented medical malpractice incidents. Liability needs to be established via competent proof submitted to the civil court hearing the case before claims for damages will be adjudicated.
