Companies in New York that fail to maintain their properties in proper condition may be held liable if visitors are injured on their properties as a result. In one recent out-of-state case, a 16-year-old boy suffered a foot injury at a Family Dollar Store due to the unsafe condition of the store’s sidewalk. The mother of the boy has thus filed a premises liability lawsuit against the store.
The boy was reportedly leaving the store one day when a stick lying on the store’s sidewalk impaled one of his feet. When the incident occurred, an employee at the store is said to have told the child and his mother that somebody had been cutting trees nearby and had neglected to clean up the resulting mess. According to the lawsuit, the stick that entered his foot damaged nerves and caused him pain and suffering.
The alleged injury accident caused the boy to have to undergo surgical procedures. According to the complaint, the boy has suffered permanent damage that requires a prosthetic insert. He is also said to have ongoing medical expenses related to the injury.
As part of the premises liability claim, the plaintiffs are seeking a jury trial. They are also seeking damages for health care costs as well as pain and suffering, with the amount to be proved at trial. When a person in New York is hurt at a business due to the negligence of the business, the injury victim has the right to seek to hold that business accountable through the civil court system.
