Medical malpractice suit filed following gallbladder surgery

On Behalf of | Jan 7, 2016 | Medical Malpractice

When a doctor makes a mistake in a procedure, this can sadly lead to major, long-lasting harm to a patient in New York. One man in another state recently claimed that a surgeon botched a gallbladder removal procedure. He has filed a medical malpractice suit against the surgeon.

The man said while he was undergoing the gallbladder removal operation, the surgeon severed the man’s bile duct on accident. In addition, the surgeon failed to repair this mistake during the operation. Because it is attached to a patient’s gallbladder, the common bile duct may be pinched, cut or burned during surgery involving the gallbladder.

The area of the bile duct can be hard to see during surgery as a result of scarring, bleeding or swelling. When a bile duct ends up being injured during an operation, bile may leak into the area of the abdomen, or the flow of bile might become blocked. In either event, injuries to the bile duct can result in serious symptoms.

The man said he suffered mental and physical pain as a result of the surgeon’s medical malpractice and also had to undergo more surgery to fix the problem. He is seeking over $50,000 in damages along with litigation costs. When medical professionals in New York fail to exercise a reasonable degree of care and cause injuries to a patient, the patient has the right to seek to hold these professionals accountable through the civil court system. Liability needs to be established in a way that pleases the court before claims for damages will be determined.
