When a doctor ends up harming the very patient he or she was expected to help in New York, it is within the legal rights of the patient to take legal action. In one out-of-state case, a man said a doctor at a university improperly placed screws in him, thus causing serious neurological problems. The man has thus filed a medical malpractice lawsuit against the university.
According to the man’s complaint, the university accepted him for medical treatment for a condition that had not been specified. However, the hospital was allegedly careless in performing a surgical operation involving pedical screws. The man said because the pedical screws were incorrectly positioned, they breached his spinal canal at several levels.
The plaintiff further said that the hospital utilized unnecessary hardware inappropriately. The facility is also accused of failing to detect neurological impairment following the operation and did not diagnose the screws as being the cause of the problem. As part of the medical malpractice lawsuit, he is seeking over $50,000 in damages as well as court costs.
When medical professionals do not exercise a reasonable degree of care when taking care of patients, patients may end up suffering permanent injuries or even losing their lives. An injured patient and the loved ones of a deceased patient have the right to file medical malpractice claims against the reportedly at-fault medical providers, seeking damages. Liability must be established in a manner that satisfies the civil court hearing the case before claims for financial damages will be decided in New York.
