Medical malpractice during a surgical procedure in New York can be life-threatening for a patient; this is why it is grounds for a lawsuit. One person in another state recently filed a medical malpractice suit against two medical care businesses as well as a doctor following a surgery on her cervical spine. She said the defendants were medically negligent while caring for her.
The woman said the doctor provided her with neurosurgical care after she complained about having pain in her neck. She said during her cervical spine surgery, however, the doctor was negligent in many ways. For instance, the doctor reportedly failed to protect the neurological and vasculature structures from excessive bleeding and damage during the surgery.
The woman said she suffered severe injuries, including hemorrhage as well as vascular injury and nerve injury. She also allegedly continued to experience bodily pain. She has sued the doctor along with a spine institute and a surgical assistants business involved in her care.
In her lawsuit, the woman is seeking over $50,000. She is seeking damages for lost time and lost wages, emotional distress, pain and suffering, and the impairment of her ability to enjoy life. In New York, whenever a medical facility or professional engages in medical malpractice that causes a person to suffer harm, the victim has the right to file a lawsuit against the allegedly at-fault party. Liability has to be established by competent proof in order for the civil court to support the victim’s claims for monetary damages.
