Breast surgeon faces medical malpractice suit

When a doctor’s negligence in New York ends up causing harm to his or her patients, this medical professional may be held accountable through the civil court system. One woman in another state recently filed a medical malpractice suit against her surgeon after he allegedly behaved negligently while performing her surgery. The surgery performed by the doctor was a breast augmentation procedure.

According to the woman, the doctor did not exercise a reasonable degree of care in treating her and thus was reckless, careless and negligent. The woman said he was also careless in his decision to do the procedure in the first place and in his follow-up care of the patient. She said this was despite the fact that she had told him about the complications she was having and had requested extra care.

The doctor is also accused of failing to appropriately tell the woman about the risks associated with the surgery and of downplaying his negligent care of her. The woman said he did not provide proper treatment of the complications and did not heal her wounds. The doctor has been the subject of litigation a minimum of six other times during the past eight years for similar situations.

As part of her lawsuit against the surgeon, the woman is seeking both compensatory damages and punitive damages. Punitive damages may be awarded in cases of egregious fault. Anybody who has suffered injuries as a result of a doctor’s choice to deviate from an appropriate standard of medical care has the right to file a medical malpractice suit in an effort to right the alleged wrongdoing in New York.
