Medical malpractice suit filed following eyelid surgery

Victims of medical malpractice in New York have the right to seek to hold the alleged perpetrator of the malpractice accountable. One woman in another state recently sued a doctor and a clinic foundation after she reportedly suffered eyelid disfigurement due to medical malpractice. She is seeking an unspecified amount in damages.

The woman said she suffered two eye conditions that caused her eyes to bulge and prevented her from closing her eyelids properly. She had to undergo surgery, but during the operation, the left eyelid was allegedly punctured. She said this caused deformity and scarring in this area, and she now struggles to close and open her eyelid. The woman said the medical mistake has also led to blurry and double vision, hypersensitivity, pain and irritation.

The woman reported that the condition resulting from the surgery has made her left eye vulnerable to more damage as well. She has accused the doctor who performed the surgery of failing to utilize the correct surgical techniques. She said the doctor also failed to tell her about the risks of the treatment, failed to let her know about the error in a timely fashion and did not appropriately address her surgical injury.

The woman is seeking damages for extra surgical procedures, pain and suffering, and scarring. She is additionally seeking damages for loss of the enjoyment of life, medical expenses, permanent disability, disfigurement and scarring. Compensatory damages will be awarded in this type of medical malpractice case in New York if there is sufficient evidence that a doctor failed to exercise a reasonable degree of care in treating a patient’s medical problem.
