Falling on a slippery surface on someone else’s property in New York can cause serious harm to an individual. For instance, a person may suffer broken bones or torn ligaments, or he or she may even suffer severe injuries to the brain or the spinal cord, which can be life-changing. In one recent out-of-state premises liability case, a man was hurt after falling on ice.
The man, a trucker, claimed he ended up slipping and falling on ice while at a trucking company office. The man said he worked as an independent contractor for the company and was visiting the office one day to turn in some paperwork. He left through a door that was different from the one he had used to enter the building, and it was there he allegedly fell on ice that had accumulated on a sidewalk area. He said the ice had built up due to water draining from an outside downspout that led from the roof of the building to the sidewalk.
The man said the fall caused him to suffer many fractures requiring surgery and that he continues to suffer pain and mobility issues. He also said the incident may cause him circulatory and muscular complications in the future. The man has filed a civil suit against the company, claiming that the company should have realized that the hazard existed but did not address it.
The man is seeking more than $50,000 in damages for pain and suffering as well as mental anguish. He is also seeking damages for loss of consortium, disfigurement, impairment and lost earning capacity and wages. Those who are injured because of a property owner’s negligence have the legal right to seek justice through a premises liability claim in New York.
