Woman files medical malpractice suit following baby delivery

Giving birth can naturally be both an exciting and nerve-racking experience. However, the guidance of a reputable doctor in New York can make the process as seamless as possible and successful. Unfortunately, in the case of one woman and baby in another state, a baby was allegedly injured during the birthing process due to a doctor’s negligence. The woman has filed a medical malpractice suit in connection with the incident.

The woman said she went to the hospital so that labor could be induced since she had pre-eclampsia. She was at term at the time. The woman said the doctor attempted to perform a vacuum-assisted delivery on the patient but ended up failing on multiple attempts.

According to her suit, after the release of the vacuum cup and the completion of the delivery, the shoulder that the cup had been attached to showed weakness. The woman said the weakness was indicative of a condition known as Erb’s palsy. The woman said the procedure ended up causing permanent damage to nerve roots as well as a brachial plexus injury.

The woman in her suit is seeking more than $150,000. It is within the rights of a patient in New York who has suffered an injury at the hands of a negligent doctor to file a medical malpractice suit, pursuing damages. Financial restitution in a case that is won may help the individual to cover related medical costs, both past and future, and help to address pain and suffering caused by the incident.
