Paul J. SweeneyPaul J. James N. Cahill(Binghamton, NY) —Coughlin & Gerhart, LLP is pleased to welcome James N. Cahill, Esq. as Of Counsel to the firm effective May 1.

Mr. Cahill joins C&G after 50+ years as an attorney, currently practicing in Endicott, NY. He will focus primarily in the areas of corporate/business/litigation.

A graduate of Notre Dame and Villanova University Law School, Mr. Cahill was admitted to the Bar in New York in 1963. In 1985, he served in the Pennsylvania and U.S. District Court of Appeals for the Northern, Southern and Western Districts of New York and in 1994 was admitted to the U.S. Court of Appeals, Second Circuit.

Holmberg Galbraith, LLP of Ithaca joins Coughlin & Gerhart, LLP

The law firm of Holmberg Galbraith, LLP of Ithaca has joined Coughlin & Gerhart, LLP effective January 1, 2017. Anna Holmberg and Dirk Galbraith have joined C&G in an "Of Counsel" role and Michael Perehinec, Jr. has joined C&G as a Senior Associate. With Holmberg Galbraith’s current location at 118 N. Tioga Street in Ithaca, this practice will become the second Coughlin & Gerhart office in Tompkins County.

Holmberg Galbraith, LLP has a well-earned reputation for providing high quality, personal service to its clients. The origins of the firm date back to 1988. Anna Holmberg and Dirk Galbraith have each been practicing law in the Ithaca area for over 35 years. C & G Attorney Speaks at The Landlords Association of Tompkins County

Michael C. Perehinec, Jr., Esq., an Associate with Coughlin & Gerhart’s Tioga Place, Ithaca office was a featured legal speaker at The Landlords Association of Tompkins County on Monday, January 23, 2017.

The question and answer format meeting focused on landlord/tenant law and related tenant disputes. Mr. Perehinec also discussed objectionable tenancies and the steps to evict an objectionable tenant.

Mark Gorgos, Managing Partner of Coughlin & Gerhart, LLP, has announced that Paul F. Eaton Jr. and Carl A. Griffith of Sidney will be joining Coughlin & Gerhart effective January 1, 2017.

Colapietro to Become Of Counsel with Coughlin & Gerhart, LLP

Coughlin & Gerhart, LLP is pleased to announce that attorney Bruno Colapietro will become Of Counsel with the firm effective March 1, 2016.

A graduate of Hamilton College, he received his Law Degree from Cornell Law School in 1960. Colapietro began practicing as an Attorney with the Department of Justice Criminal Division in Washington, DC and then became a Partner at Chernin & Gold. He most recently Colapietro Brunoserved as Of Counsel with Levene Gouldin & Thompson.

Mr. Colapietro was also a former Instructor at Hinman College, now Binghamton University, Adjunct Professor of Law at Cornell Law School for thirty years, President of the Broome County Bar Association, a frequent lecturer at local and State Bar Association Meetings, author of numerous articles on Family Law matters; Author of "Law and the Family" manual (1989), and currently a Chairman of the Broome County Legal Aid Child Support Matters, among many other professional and community-based involvements. He has been a member of the American Academy of Matrimonial Lawyers since 1975.

Coughlin & Gerhart, LLP Named Greater Binghamton Chamber's Corporate Citizen of the Year

Coughlin & Gerhart Corporate Citizen of the YearCoughlin & Gerhart was recently honored with the CORPORATE CITIZEN OF THE YEAR AWARD by the Broome County Chamber of Commerce at the annual Community Thanksgiving Luncheon on November 17. The award is "awarded to a company that has made not only a financial commitment to the Greater Binghamton area, but a commitment to providing leadership and hands-on employee participation."

Managing Partner Mark Gorgos credited Coughlin & Gerhart's staff, associates and partners for pointing out what's needed and facilitating volunteerism.

"Really, community service is not just the right thing to do," he said. "It's really the fabric of our law firm and I'm really proud of my partners for sharing those visions and initiative with us."

We at C&G thank the Chamber for this award, and thank all of our employees and other individuals and businesses in the community whose efforts and contributions enable us at C&G to give back to the community.

In presenting the award, the Chamber discussed some of C&G's charitable fundraising and efforts through the year and stated:

"The attorneys and staff at Coughlin & Gerhart have a strong belief that their community efforts and contributions made to those in need enhance the quality of life for everyone. This attitude definitely comes from the strong examples set by the leadership of the firm. This past July marked the 15th annual "Golf for Scholars" tournament that the firm organized and runs. To date, over $180,000 has been raised to benefit local school districts' scholarship programs. For the second year, Coughlin & Gerhart was the lead sponsor of the Race for Justice 5K to benefit the Legal Aid Society. The firm also paid the registration fee for any employee and their family member(s) who wanted to walk or run the race.

Coughlin & Gerhart contributes to a host of other organizations. They are a major contributor to the United Way, with a different Staff person running the campaign each year. This year, a basket raffle competition between practice groups will be held to help raise money for the campaign. Coughlin & Gerhart is a Lead Sponsor for the Annual Sertoma Club Antique Show; and a consistent sponsor of the Helping Celebrate Abilities (HCA) Tasteful Day fundraiser.

The Firm holds 'Jeans Day' every Friday; donations are collected from partners, associates and staff for the 'privilege' of wearing jeans to work. All donations are then given to a local charity, suggested by the employees.

They actively support many of the area's charity golf and basketball tournaments. They also sponsor ACHIEVE'S 'Growing Spaces, Improving Lives' building rehabilitation project. Not only are monetary donations made to local organizations, but attorneys and staff are encouraged to give of their time and talents to these organizations. Attorneys are encouraged to become active Board members and to take leadership roles -their involvement includes: Broome County Arts Council, American Civic Association, Binghamton Boys & Girls Club, Roberson Museum and many others.

For several years now, one of the Coughlin & Gerhart staff coordinates the creating and decorating of fleece blankets and stockings, with the help of co-workers and attorneys. These blankets and stockings are then donated to the Children's Home during the Holiday Season. This one activity alone encompasses the entire year!

Coughlin & Gerhart, LLP presented at a special National Labor Relations Paul 10 Board ("NLRB") Update on March 26, 2015 at the Doubletree by Hilton in Binghamton, NY. Over 60 attendees from local businesses were advised of important changes being implemented by the NLRB. The co-chairs of the firm's Labor and Employment Law Group, Joseph J. Steflik, Jr. and Paul J. Sweeney, spoke on topics including the NLRB's so-called Joe 10 "Quickie Election" rules, the formation of "micro" bargaining units and the enforcement of social media policies.

NYS Court of Appeals Issues Favorable Decision for Coughlin & Gerhart Clients on Critical Oil & Gas Lease Interpretations

The New York State Court of Appeals issued a landmark decision in a Force Majeure case being handled by the attorneys at Coughlin & Gerhart, LLP, finding that the Force Majeure clause did not extend the leases and that the leases expired by their terms. The case came before the New York State OildisputesCourt of Appeals when the United States Court of Appeals for the Second Circuit certified two questions. This important decision remains very meaningful to landowners for future gas development.

In this lawsuit, Coughlin & Gerhart, LLP represented landowners against three energy companies on the issue of whether the term of expired oil & gas leases can be extended by Force Majeure due to the moratorium on high-volume hydrofracking in New York. The New York State Court of Appeals held that the Force Majeure clause did not modify the habendum clause (term clause) and, therefore, the leases terminated at the conclusion of their primary term. This is a significant victory for landowners and their property rights. The Plaintiffs in this case will now have the opportunity to renegotiate their oil and gas leases when gas development begins in New York and are no longer burdened by the very poor terms of the previous leases. Additionally, landowners who were not a part of this case will benefit from this precedent-setting decision which highlights the importance of having a skilled and experienced oil and gas attorney review an oil and gas lease before signing.

Second Circuit Issues Recent Decision on Force Majeure Asserted by Energy Companies in Oil & Gas Leases

The United States Court of Appeals for the Second Circuit has certified two questions for the New York State Court of Appeals in a Force Majeure case being handled by the attorneys at Coughlin & Gerhart, LLP, finding that the case raises significant and novel questions of New York oil & gas law.

In this lawsuit, the lawyers of Coughlin & Gerhart represent landowners against three energy companies on the issue of whether the term of expired oil & gas leases can be extended by Force Majeure due to the moratorium on high-volume hydrofracking in New York. The trial court, the U.S. District Court for the Northern District of New York, had previously ruled in favor of our landowner clients, concluding that the attonreyleases cannot be extended; the energy companies appealed. This Second Circuit decision was rendered in connection with that appeal. Coughlin & Gerhart and its landowner clients are now waiting for the NYS Court of Appeals to determine whether they will accept the offer to decide the certified questions.
